Sample 30 Day Excuse Response
This letter is to be used ONLY if you have gotten a response from the debt collector that states your 30 days to validate has expired. You may use the SAME validation (or Creditor Disclosure Statement) as used in your first validation. This is simply an introduction letter to add to your validation. Make sure you change the length of time that the debt collector has to respond to 10 days instead of 30 days on the validation request.
To use this letter you can click at the beginning of it with your mouse, highlight the ENTIRE letter by dragging your mouse to the end of it while still holding down the mouse button. When you reach the end of the letter and see that it is all highlighted, right click on your mouse and select COPY. You will then need to open a word processing program such as Microsoft Word or Notepad. I am in receipt of your claim that my 30 days in which to validate this alleged debt has expired. I must inform you that I have never received any form of communications from your office in writing. If you are able to provide sufficient evidence that I have actually received a collection notice from your company (i.e. certified letter return receipt with my signature on it) I will be more than happy to withdraw my validation request.
As per the FDCPA, it is a violation for ANY debt collector to pursue collection activity on an account without notifying the alleged debtor in writing within 5 days after any telephone communication. I have received NO such written communication from you, therefore my time to request validation on this alleged account has not expired and your company is already in direct violation of the FDCPA.
Since your company has knowingly and willingly violated the FDCPA and the FCRA by continuing collection activity on this alleged account, I will have no choice but to file complaints with the Better Business Bureau, the Federal Trade Commission and the State Attorney General’s Office if you continue to make excuses for not providing validation of this alleged debt.
Your offices now have 10 days from the date of this letter to respond to my original validation request and provide me with copies of all information contained in that letter. If you fail to respond to that request, I will file complaints with all of the offices noted above and will also be considering this account for legal suit.
Sincerely
